FlowPrompter Terms of Service

Welcome to FlowPrompter. These Terms of Service ("Terms") govern your use of the FlowPrompter mobile application and the FlowPrompter Web Studio (collectively, the "Services"), operated by Buitron Inc ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of Terms, Privacy, and Age Requirements

Privacy Policy: Your privacy is important to us. Our data collection, processing, retention, and your rights (including GDPR and CCPA/CPRA rights) are detailed in our Privacy Policy. By using the Services, you consent to our data practices.

Age Restrictions: You must be at least 13 years old (or 16 years old if residing in the European Economic Area/UK) to use FlowPrompter. We do not knowingly collect information from children without parental consent.

2. Description of Service and AI Integrations

FlowPrompter is a cross-platform teleprompter software providing voice-tracking technology, cloud-syncing, and AI-assisted script generation.

Third-Party Integrations

We utilize third-party services including Supabase (database/auth), RevenueCat and Stripe (subscription management), Google/Apple (native speech recognition), and OpenAI (AI writing features).

AI Disclaimer

If you use our AI Ghostwriter, your prompts are processed by OpenAI. AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, editing, and verifying any AI-generated scripts before use. We claim no ownership over AI outputs, nor do we guarantee their accuracy. You agree to comply with OpenAI’s usage policies.

3. Acceptable Use and Fair Usage

You agree not to misuse the Services. You may not: (a) reverse engineer, decompile, or disassemble the Services; (b) use automated scripts, bots, or scrapers to access the Services or abuse the AI Ghostwriter feature; (c) use the Services to generate illegal, harmful, or highly deceptive content; or (d) share your Pro account credentials with multiple unverified users to bypass subscription limits.

4. User Accounts and Security

To utilize cloud syncing and Web Studio features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials.

Security Breaches: You agree to notify us immediately of any unauthorized account access. We strongly recommend using secure authentication methods provided by Google Auth or Apple.

5. Subscriptions, Auto-Renewals, and Cancellations

FlowPrompter offers free features and a premium cross-platform subscription ("Pro"). How you manage your subscription depends on where you purchased it:

• Web Subscriptions (Stripe): If you purchased Pro via our website, your subscription is managed securely via Stripe. You may update your payment method or cancel your subscription at any time by accessing the Customer Billing Portal linked in your account settings.
• Mobile Subscriptions (Apple/Google): If you purchased Pro via the iOS App Store or Google Play Store, your subscription is managed entirely by Apple or Google. You must cancel through your respective device's Subscriptions settings. Deleting the App or your FlowPrompter account will not cancel these mobile subscriptions.

Auto-Renewal (California SB 343 Compliance): Pro subscriptions are billed automatically based on the term you select. Your subscription will automatically renew at the specified price and frequency unless you cancel at least 24 hours before the end of the current billing period.

Refunds and EU Right of Withdrawal: For mobile purchases, refunds are handled entirely by Apple or Google. For web purchases, we do not offer prorated refunds for canceled subscriptions. If you are an EU/UK consumer, you have a statutory right to cancel your purchase within 14 days; however, by accessing the digital Pro features immediately upon purchase, you acknowledge that you waive this withdrawal right.

6. Intellectual Property and Limited License

Buitron Inc retains all rights, title, and interest in the Services, including our original code, proprietary voice-tracking algorithms, designs, and trademarks. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or commercial content creation.

7. User Content and Data Retention

Your Content: You retain full ownership of all scripts you create and videos ("Takes") you record. Video Takes are stored strictly locally on your device. Scripts are synced to our secure cloud database.

Data Retention: We retain your account data and cloud scripts only as long as your account remains active. Upon account deletion, your cloud data is permanently deleted.

8. Termination

You may terminate this agreement at any time by deleting your account. We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms or our Acceptable Use policies.

9. Disclaimer of Warranties

FOR USERS ON THE FREE TIER, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

EU/UK Paid Consumers: If you are a paid Pro subscriber in the EU or UK, the above disclaimer does not affect your statutory rights. We will provide the premium services with reasonable skill and care.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUITRON INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Liability Cap: In no event shall our total aggregate liability exceed the greater of fifty U.S. dollars ($50.00) or the amount you paid us in the past twelve (12) months.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of California, United States. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles, California.

12. Accessibility Statement

Buitron Inc is committed to making our Services accessible to everyone, including individuals with disabilities. We continuously strive to improve the user experience for all and apply relevant accessibility standards.
